By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services

Lake Point Chicago LLC provides B2B administrative operations, lead generation, digital infrastructure, vendor management, and related professional services to corporate clients and established professionals. All services are subject to a separate written service agreement executed between the Company and the client.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to active clients.

2. Eligibility

Our services are intended for business entities and professionals aged 18 or older. By using our services, you represent that you have the legal authority to enter into binding agreements on behalf of yourself or your organization.

3. Service Disclaimer

All services are provided on an "as-is" and "as-available" basis. While we strive for excellence in all deliverables:

• Service outcomes may vary based on client requirements, market conditions, and operational scope.
• Past performance, including any illustrative case studies or metrics presented on our website, does not guarantee future results.
• Any projections, estimates, or illustrative scenarios presented are for informational purposes only and do not constitute warranties or guarantees.
• We do not guarantee specific lead volumes, conversion rates, or revenue outcomes from our B2B lead generation services.

4. Client Responsibilities

Clients engaging our services agree to:

• Provide accurate and complete information necessary for service delivery.
• Comply with all applicable laws and regulations in connection with use of our services.
• Not use our services for any unlawful, deceptive, or fraudulent purpose.
• Maintain confidentiality of any proprietary information, systems, or credentials provided by the Company.
• Make timely payments as specified in service agreements.

5. TCPA and Outreach Compliance

All lead generation and outreach activities conducted by Lake Point Chicago LLC are performed in compliance with:

• Telephone Consumer Protection Act (TCPA)
• Federal Trade Commission (FTC) regulations
• CAN-SPAM Act for email communications
• National Do Not Call Registry requirements
• Applicable state laws governing telemarketing and B2B outreach

Clients are responsible for ensuring their use of leads and contact information delivered by the Company complies with all applicable laws.

6. Payment Terms

Payment terms, rates, and schedules are specified in individual service agreements. Unless otherwise agreed:

• Invoices are due within fifteen (15) business days of issuance.
• Late payments may incur interest at 1.5% per month or the maximum rate permitted by law.
• Services may be suspended for non-payment after reasonable notice.
• All fees are non-refundable unless expressly stated in the applicable service agreement.

7. Cancellation and Termination

Either party may terminate a service agreement in accordance with the notice provisions specified therein. Upon termination:

• All outstanding fees for services rendered become immediately due and payable.
• Client data will be retained for 30 days post-termination before deletion.
• Confidentiality obligations survive termination.
• The Company reserves the right to immediately terminate services for material breach, illegal activity, or non-payment.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary and sensitive information disclosed in connection with services. Neither party shall disclose confidential information to third parties without prior written consent, except as required by law. Confidentiality obligations survive termination of service agreements for three (3) years.

9. Intellectual Property

All content on www.lakepointchicago.com including text, graphics, logos, and design elements are the property of Lake Point Chicago LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Lake Point Chicago LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities, arising from use of our services or website. Our total liability for any claim arising from our services shall not exceed the amounts paid by the client in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Lake Point Chicago LLC, its members, officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall first be subject to good faith negotiation for thirty (30) days. Unresolved disputes shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules in Chicago, Illinois.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website at least fourteen (14) days before taking effect. Continued use of our services after changes constitutes acceptance of the updated Terms.

14. Entire Agreement

These Terms, together with our Privacy Policy and any applicable service agreement, constitute the entire agreement between you and Lake Point Chicago LLC regarding use of our website and services.
